關(guān)于推行“上海市家庭居室裝飾裝修施工合同文本”的通知
浦東新區(qū)、各區(qū)、縣工商行政管理局、建設(shè)委員會（建設(shè)局）：
1997年9月11日，市工商局、市建委下達(dá)了《關(guān)于使用民用住房裝飾施工合同推薦文本的通知》（滬工商合〖1997〗425號文）在全市范圍內(nèi)推行《民用住房裝飾施工合同（推薦文本）》。文本使用至今對保護(hù)消費(fèi)者合法權(quán)益、規(guī)范裝飾市場交易行為起到了積極的作用。為進(jìn)一步發(fā)揮該合同文本的作用，我們根據(jù)有關(guān)規(guī)定和實(shí)際使用中遇到的問題，對《民用住房裝飾施工合同（推薦文本）》進(jìn)行了修訂。現(xiàn)就有關(guān)事宜通知如下：
一、原《上海市民用住房裝飾施工合同》（推薦文本）現(xiàn)更名為《上海市家庭居室裝飾裝修施工合同》，并于1999年4月1日起在全市施行。
二、裝飾企業(yè)在1999年9月30日前仍可使用已購買的《上海市民用住房裝飾施工合同》（推薦文本）。
三、《上海市家庭居室裝飾裝修施工合同》由市工商局會同市建委負(fù)責(zé)印制、發(fā)放，其他任何單位不得擅自印刷、銷售。

根據(jù)《中華人民共和國合同法》、《建筑安裝工程承包合同條例》、《中華人民共和國消費(fèi)者權(quán)益保護(hù)法》、《中華人民共和國價(jià)格法》、《上海市保護(hù)消費(fèi)者合法權(quán)益條例》，中華人民共和國建設(shè)部（1997）92號文《家庭居室裝飾裝修管理試行辦法》以及其他有關(guān)法律法規(guī)規(guī)定的原則，為保護(hù)雙方的合法權(quán)益，結(jié)合本工程的具體情況，雙方達(dá)成如下協(xié)議，共同遵守。
一、概況
1．甲方裝飾住房系合法居住。
乙方為本市經(jīng)工商行政管理機(jī)關(guān)核準(zhǔn)登記并經(jīng)市建委有關(guān)部門審定具有民用裝飾《資質(zhì)證書》的企業(yè)法人。
2．裝飾施工地點(diǎn)：_________區(qū)（縣）___________路____弄（村）____號___樓____室。
3．住房結(jié)構(gòu)：____________房型______房_____廳_____套，施工面積___________平方米。
4．裝飾施工內(nèi)容：詳見附件一《裝飾施工內(nèi)容表》。
5．承包方式：__________________（包工包料、清包工、部分承包）。

On the implementation of the "family room decoration Shanghai Construction Contract text" notice
Pudong New Area, District and County Administration for Industry, Construction Committee (Construction Bureau):
September 11, 1997, Industry and Commerce Bureau, the Municipal Construction Commission issued a "decoration on the use of civilian housing construction contract recommended by the text of the notice" (Shanghai industrial and commercial cooperation〗 〖425 1997 text) in the city for the implementation of the "civilian housing construction contract decoration (recommended text). " The text is still in use to protect legitimate rights and interests of consumers, regulate market transactions decoration played a positive role. In order to play the role of the text of the contract, we actually used in accordance with relevant provisions and the problems encountered on the "civilian housing decoration construction contract (recommended version)" was revised. Notice on the matter are as follows:
First, the original "Shanghai civilian housing decoration construction contract" (recommended version) is now renamed "family room decoration Shanghai Construction Contract", and in April 1, 1999 implementation at the city.
Second, decoration company in September 30, 1999 can still be purchased using the "Shanghai civilian housing decoration construction contract" (recommended text).
Third, "the family room decoration Shanghai Construction Contract" Municipal Industry and Commerce jointly with the municipal construction committee responsible for the production, distribution, not allowed to print any other unit sales.

According to "Contract Law", "construction and installation contract regulations," "The People's Republic of China Consumer Protection Law", "Price Law of PRC", "legitimate rights and interests of consumer protection regulations in Shanghai," People Republic Ministry of Construction (1997) 92 Man "family room decoration Trial Procedures" and other relevant laws and regulations of the principles for protection of the legitimate rights and interests, combined with the specific circumstances of this project, the two sides reached the following agreement to abide by.
