        第一部分    合同條件
               一、詞語(yǔ)含義及合同文件
              第一條  詞語(yǔ)含義。在本合同中,下列詞語(yǔ)除協(xié)議條款另有約定外,應(yīng)具有本條所賦予的含義。
              1.合同:是指為實(shí)施工程,發(fā)包方和承包方之間達(dá)成的明確相互權(quán)利和義務(wù)關(guān)系的協(xié)議,包括合同條件、協(xié)議條款以及雙方協(xié)商同意的與合同有關(guān)的全部文件。
              2.協(xié)議條款:是指結(jié)合具體工程,除合同條件外,經(jīng)發(fā)包方和承包方協(xié)商達(dá)成一致意見(jiàn)的條款。
              3.發(fā)包方〈簡(jiǎn)稱甲方):協(xié)議條款約定的具有工程發(fā)包主體資格和支付工程價(jià)款能力的當(dāng)事人。
               甲方的具體身份、發(fā)包范圍、權(quán)限、性質(zhì)均需在協(xié)議條款內(nèi)約定。
               4.承包方(簡(jiǎn)稱乙方):協(xié)議條款約定的具有工程承包主體資格并被甲方接受的當(dāng)事人。
               5.甲方駐工地代表(簡(jiǎn)稱甲方代表):甲方在協(xié)議條款內(nèi)指定的履行合同的負(fù)責(zé)人。
               6.乙方駐工地代表(簡(jiǎn)稱乙方代表):乙方在協(xié)議條款內(nèi)指定的履行合同的負(fù)責(zé)人。
               7.社會(huì)監(jiān)理:甲方委托具備法定資格的工程建設(shè)監(jiān)理單位對(duì)工程進(jìn)行的監(jiān)理。
               8.總監(jiān)理工程師:工程建設(shè)監(jiān)理單位委派的監(jiān)理總負(fù)責(zé)人。
              9.設(shè)計(jì)單位2甲方委托的具備與工程相應(yīng)資質(zhì)等級(jí)的設(shè)計(jì)單位。本合同工程的裝飾或二次及以上的裝飾,甲方委托乙方部分或全部設(shè)計(jì),且乙方具備相應(yīng)設(shè)計(jì)資質(zhì),甲、乙雙方另行簽訂設(shè)計(jì)合同。
              10.工程:是指為使建筑物、構(gòu)筑物內(nèi)、外空間達(dá)到一定的環(huán)境質(zhì)量要求,使用裝飾裝修材料,對(duì)建筑物、構(gòu)筑物外表和內(nèi)部進(jìn)行修飾處理的工程。包括對(duì)舊有建筑物及其設(shè)施表面的裝飾處理。
              11.工程造價(jià)管理部門2各級(jí)建設(shè)行政主管部門或其授權(quán)的建設(shè)工程造價(jià)管理部門。
              12.工程質(zhì)量監(jiān)督部門:各級(jí)建設(shè)行政主管部門或其授權(quán)的建設(shè)工程質(zhì)量監(jiān)督機(jī)構(gòu)。
              l3.合同價(jià)款;甲、乙雙方在協(xié)議條款內(nèi)約定的、用以支付乙方按照合同要求完成全部工程內(nèi)容的價(jià)款總額。招標(biāo)工程的合同價(jià)款為中標(biāo)價(jià)格。
              14.追加合同價(jià)款:在施工中發(fā)生的、經(jīng)甲方確認(rèn)后按計(jì)算合同價(jià)款的方法增加的合同價(jià)款。
            l5.費(fèi)用:甲方在合同價(jià)款之外需要直接支付的開(kāi)支或乙方應(yīng)承擔(dān)的開(kāi)支。
            16.工期:協(xié)議條款約定的、按總?cè)諝v天數(shù)(包括一切法定節(jié)假日在內(nèi))計(jì)算的工期天數(shù)。
            17.開(kāi)工日期:協(xié)議條款約定的絕對(duì)或相對(duì)的工程開(kāi)工日期。.
            18.竣工日期:協(xié)議條款約定的絕對(duì)或相對(duì)的工程竣工日期。
