第一章　合同一般規范

　　第１條　詞語涵義。建設工程施工合同文本，由建設工程施工合同條件（以下簡稱合同條件）和建設工程施工合同協議條款（以下簡稱協議條款）組成。其用詞用語除協議條款另有約定外，應具有本條所賦予的涵義。
　　１．發包方（簡稱甲方）：協議條款約定的、具有發包主體資格和支付工程價款能力的當事人。
　　２．甲方駐工地代表（簡稱甲方代表）：甲方在協議條款中指定的代表人。
　　３．承包方（簡稱乙方）：協議條款約定的、具有承包主體資格并被發包方接受的當事人。
　　４．乙方駐工地代表（簡稱乙方代表）：乙方在協議條款中指定的代表人。
　　５．社會監理：甲方委托具備法定資格的工程監理單位或人員對工程進行的監理。
　　６．總監理工程師：工程監理單位委派的監理總負責人。
　　７．設計單位：甲方委托的具備相應資質等級的設計單位。
　　８．工程造價管理部門：國務院有關部門、各級建設行政主管部門或其授權的工程造價管理部門。
　　９．工程質量監督部門：國務院有關部門、各級建設行政主管部門或其授權的工程質量監督機構。
　　１０．工程：協議條款約定具體內容的永久工程。
　　１１．合同價款，按有關規定或協議條款約定的各種取費標準計算的，用以支付乙方按照合同要求完成工程內容的價款總額。
　　１２．經濟支出：在施工中已經發生，經甲方確認后以增加預算形式支付的合同價款。
　　１３．費用：甲方在合同價款之外，需要直接支付的開支和乙方應負擔的開支。
　　１４．工期：協議條款約定的合同工期。
　　１５．開工日期：協議條款約定的工程開工日期。
　　１６．竣工日期：協議條款約定的工程竣工日期。
　　１７．圖紙：由甲方提供或乙方提供經甲方代表批準，乙方用以施工的所有圖紙（包括配

The two sides through friendly consultations, reached the following common terms of the contract:

Chapter I General specifications for the contract

Article 1 Meaning of words. Building construction contracts, building construction by the terms of the contract (hereinafter referred to as contract terms), and the terms of Construction Contract (hereinafter referred to as terms of the agreement) form. 9. Project quality supervision departments: the State Council departments, or administrative departments at all levels of construction projects authorized by the quality of oversight bodies.
10. Engineering: the specific content of the agreed terms of the agreement permanent works.
11. The contract price, according to the provisions or terms of the agreement agreed to take charge of various criteria calculated in accordance with contractual requirements to pay Party B the price of the contents of the total amount of construction work.
12. Economic costs: The construction has already occurred, confirmed by Party A to increase the budget, paid the contract price.
