建設工程施工合同條件
第一章 詞語涵義及合同文件
第一條 詞語涵義。建設工程施工合同文本，由建設工程施工合同條件(以下簡稱合同條件)和建設工程施工合同協議條款(以下簡稱協議條款)組成。其用詞用語除協議條款另有約定外，應具有本條款所賦予的涵義：
1.發包方(簡稱甲方)：協議條款約定的、具有發包主體資格和支付工程價款能力的當事人。
2.甲方駐工地代表(簡稱甲方代表)：甲方在協議條款中指定的代表人。
3.承包方(簡稱乙方)：協議條款約定的、具有承包主體資格并被發包方接受的當事人。
4.乙方駐工地代表(簡稱乙方代表)：乙方在協議條款中指定的代表人。
5.社會監理：甲方委托具備法定資格的工程監理單位或人員對工程進行的監理。
6.總監理工程師：工程監理單位委派的監理總負責人。
7.設計單位：甲方委托的具備相應資質等級的設計單位。
8.工程造價管理部門：國務院各有關部門、各級建設行政主管部門或其授權的工程造價管理部門。
9.工程質量監督部門：國務院各有關部門、各級建設行政主管部門或其授權的工程質量監督機構。
10.工程：協議條款約定具體內容的永久工程。
12.合同價款：按有關規定或協議條款約定的各種收費標準計算的，用以支付乙方按照合同要求完成工程內容的價款總額。
Construction Contract Conditions
Chapter Meaning of words and the contract documents
The first words meaning. 8. Project Cost Management: The State Council departments, administrative departments at all levels of construction or the authorized project cost management.
9. Engineering quality supervision departments: the State Council departments, or administrative departments at all levels of construction projects authorized by the quality of oversight bodies.
10. Project: the terms of the specific content of the permanent works contract.
12. Contract price: According to relevant provisions of the agreement or the terms of the various fees calculated to cover the Party required to complete projects in accordance with the contents of the contract total price.
