電力建設工程施工合同條件

第一章　詞語涵義及合同文件

第一條　詞語涵義
　　《電力建設工程施工合同》文本，由《電力建設工程施工合同條件》（以下簡稱《合同條件》和《電力建設工程施工合同協議條款》（以下簡稱《協議條款》）組成，其用詞用語除《協議條款》另有約定外，應具有本條所賦予的涵義：
　　１．發包方（簡稱甲方）；《協議條款》約定的具有工程發包主體資格和支付工程價款能力的當事人。
　　２．甲方駐工地代表（簡稱甲方代表：甲方在《協議條款》中指定的代表人。
　　３．承包方（簡稱乙方）：《協議條款》約定的、具有《電力施工企業資質管理辦法》規定的工程承包主體資格并被發包方接受的當事人。
　　４．乙方駐工地代表（簡稱乙方代表）：乙方在《協議條款》中指定的代表人。
　　５．社會監理：受甲方委托、具備《電力工程建設監理單位資質管理辦法》規定資格的工程監理單位或人員對工程進行的監理。
　　６．總監理工程師：工程監理單位委派的監理總負責人。
　　７．設計單位：甲方委托的具備《電力工程勘察設計單位資質管理辦法》規定的相應資質等級的設計單位。
　　８．工程造價管理部門：國務院各有關部門、各級建設行政主管部門或如上部門授權的建設工程造價管理機構。

Chapter Meaning of words and the contract documents


The first meaning of the words
"Power Construction Contract," the text, from "Power Construction Contract Conditions" (hereinafter referred to as "Contract Conditions" and "Power Construction Contract Articles of Agreement" (hereinafter referred to as "terms"), and its terms except terms "terms of the agreement," otherwise agreed, shall have the meaning ascribed to this article:
1. Party giving (Party); "the terms" agreement with engineering contracting works price of the main qualifications and ability to pay the party.

7. Designer: Party entrusted with "power engineering survey and design management approach, the qualification" provided the appropriate qualification level design unit.
8. Project Cost Management: The State Council departments, administrative departments at all levels of construction or the above agencies authorized construction project cost management organizations.
