        《案例1》某建筑工程采用邀請(qǐng)招標(biāo)方式。業(yè)主在招標(biāo)文件中要求: (1)項(xiàng)目在21個(gè)月內(nèi)完成, (2)采用固定總價(jià)合同, (3)無調(diào)價(jià)條款。承包商投標(biāo)報(bào)價(jià)364000美元,工期24個(gè)月。在投標(biāo)書中承包商使用保留條款,要求取消固定價(jià)格條款,采用浮動(dòng)價(jià)格。但業(yè)主在未同承包商談判的情況下發(fā)出中標(biāo)函,同時(shí)指出:(1) 經(jīng)審核發(fā)現(xiàn)投標(biāo)書中有計(jì)算錯(cuò)誤,共多算了7730美元。業(yè)主要求在合同總價(jià)中減去這個(gè)差額,將報(bào)價(jià)改為356270(即364000-7730)美元。(2) 同意24個(gè)月工期。(3) 堅(jiān)持采用固定價(jià)格。承包商答復(fù)為: (1)如業(yè)主堅(jiān)持固定價(jià)格條款,則承包商在原報(bào)價(jià)的基礎(chǔ)上再增加75000美元。 (2)既然為固定總價(jià)合同,則總價(jià)優(yōu)先,計(jì)算錯(cuò)誤7730美元不應(yīng)從總價(jià)中減去。則合同總價(jià)應(yīng)為439000(即364000+75000)美元。在工程中由于工程變更,使合同工程量又增加了70863美元。工程最終在24個(gè)月內(nèi)完成。最終結(jié)算,業(yè)主堅(jiān)持按照改正后的總價(jià)356270美元并加上的工程量增加的部分結(jié)算,即最終合同總價(jià)為427133美元。而承包商堅(jiān)持總結(jié)算價(jià)款為509863(即364000+75000+70863)美元。最終經(jīng)中間人調(diào)解,業(yè)主接受承包商的要求。案例分析: (1)對(duì)承包商保留條款,業(yè)主可以在招標(biāo)文件,或合同條件中規(guī)
