第一章    定義與解釋

第一條 定義
本合同（按下文所定義的）中的下列詞和用語，除文中另有要求者外，應具 有本條所賦予的含義：
1.1 雇主是指本合同所指明的當事人以及取得此當事人資格的合法繼承人，但 除非承包商同意，不包括此當事人的任何受讓人，本合同中的雇主為……（填入 名稱）。
1.2 承包商是指其投標書已為雇主接受的當事人以及取得此當事人資格的合 法繼承人，但除非雇主同意，不指此當事人的任何受讓人。本合同中的承包商 為……（填入名稱）。
1.3 分包商是指本合同中指定作為分包工程某一部分的分包商的任何當事人， 或由工程師同意已將工程的某一部分分包給他的任何當事人以及取得該當事人資 格的合法繼承人，但不指此當事人的任何受讓人。
1.4 工程師是指雇主為本合同目的而指定作為工程師，或由雇主隨時指派并 書面通知承包人要為本合同目的替代上述指定的工程師以工程師身份行事的

Chapter I Definitions and Interpretation
