工程變更、簽證管理辦法

為了明確承包人和發(fā)包人雙方的權益，減少施工、結算中因變更、簽證不規(guī)范引起的糾紛和爭議，特制定如下管理辦法共同執(zhí)行：

一、設計變更、現(xiàn)場簽證的確認：
    設計變更、現(xiàn)場簽證是施工圖紙的補充部分，與正式施工圖紙一樣具有同等的法律效力，設計變更、現(xiàn)場簽證一經確認，發(fā)包人和承包人雙方必須按規(guī)定嚴格執(zhí)行。
1、設計變更的確認：施工中，發(fā)包人需對原工程設計進行變更，其設計變更必須由設計院簽發(fā)，格式執(zhí)行建委規(guī)定的表格。
2、現(xiàn)場簽證的確認：施工中承包人不得對原設計進行變更。由于圖紙錯誤或工藝、標準等原因引起的變更，應由承包人根據(jù)現(xiàn)場的實際情況填寫現(xiàn)場簽證單，簽字蓋章后交監(jiān)理公司，由監(jiān)理工程師、甲方專業(yè)工程師簽字確認后生效。手續(xù)不全者則視為無效簽證。
3、施工中的隱蔽工程驗收證明、施工會議記錄、紀要、施工日志等均不能作為變更、簽證的依據(jù)，更不能作為工程結算的依據(jù)。

二、執(zhí)行變更、簽證的程序和責任：
1、承包人在接到被確認的變更、簽證后應根據(jù)變更、簽證的具體要求執(zhí)行。
2、承包人在施工過程中執(zhí)行經確認后的變更、簽證而導致合同價款的變更及造成承包人的損失由發(fā)包人承擔，延誤的工期相應順延。
